  • Seek the best? Or Pay your way out, cause that is what will happen now. The folks of W-B Twp will now fot the bill due to the lawsuit that forces them to pay. Since they are forcing a law that makes them change AFTER they were issued a permit, they WILL be paid damages. We now have to pay that. HIgher taxes in 2007! Cause the amount will be high.

    Strip club sues over W-B Twp. regulations
    Gentlemen’s Club 10 says township’s ordinances are illegal, do not pertain to it.

    WILKES-BARRE – An attorney for Gentlemen’s Club 10 filed a lawsuit Wednesday challenging the legality of Wilkes-Barre Township’s ordinances restricting activities at strip clubs.

    The suit, filed by attorney Elaine Cook, asks for a judge to interpret how the ordinances apply to the all-nude strip club and prevent the township from enforcing the ordinances at the Mundy Street club.

    Cook in February filed a similar suit. That suit was later withdrawn for legal reasons, Cook has said.

    Wednesday’s suit, filed against a slew of township officials in Luzerne County Court of Common Pleas, is the latest in the long-lasting squabble between the club and township.

    It began when club owner, Sal Scalzo, filed an application to open the club. The township never gave him a hearing on the application and refused to give him the necessary permits to open.

    He sued, and Luzerne County Court of Common Pleas Judge Michael Conahan later ordered the township to give Scalzo the permits because the township, as required by law, was supposed to give Scalzo a hearing.

    The township appealed but the Commonwealth Court backed Conahan, clearing the way for the club to open.

    After Scalzo filed the applications, the township passed the ordinances.

    The ordinances limit what dancers in the club would be allowed to do, include being forbidden from accepting tips from patrons or performing simulated sex acts. Dancers would also be forced to stay 20 feet away from patrons and hours of operation would be limited from 10 p.m. to 1 a.m.

    Later, a May 16 referendum prohibiting bottle clubs from operating within the township was passed.

    But, in the suit, Cook said the ordinances are illegal in a number of ways. Plus, she said, those ordinances weren’t enacted until after the club was in existence.

    Cook also said she and the township have a dispute over whether the referendum applies to Gentlemen’s Club 10.

    The referendum, she said, also wasn’t passed until after the club had opened.

    And since the club opened, it has been in operation “without adverse affect on any surrounding neighborhood or properties,” the suit said.

    Attorney Cook must be thinking of the almighty dollar first and not thinking at all, when she said in the law suit has been in operation without adverse affect on any surronding neighborhood or properties.
    I guess she is not aware of the affect strip clubs have on families, relationships, be it boyfriend & girlfriend or husband & wife, or parents and daughters when they are young and see the lure of "easy money" dancing and what goes along with it...her young life drops into this "underworld" of exploitation* (see below for meaning girls) and lack of morality, instead of remaining on the right track and hard work that education demands to REALLY suceed in life!
    Attorney Cook needs to get into the real world and see what she is defending.

    Can you give me examples of where property values have gone down in value since the club 10 opened? NO!
    Has the rental price of any nearby businesses gone down since the opening? NO!!
    Has anyone residential property value gone down NO!
    Do you think the Delbaso's
    ( the building's owner's) would have rented the leased premises to someone whose business would lower their property values and other rental incomes? NO!
    try researching your allegations and try to find proof of what you say, You cannot. It does not exist.
    Communities who tried to keep out strip clubs on the grounds they lower property values etc lost in court. Why? because they cannot offer proof their claims are true.
    As far as the rest of your claims go:
    Instead of realizing thr true reasons a relationship fails, it is all to easy to blame it/ scapegoat it on a stripclub.
    If 18 year olds are old enough to have children/marry/go to war/
    then why are they too young if they choose to dance in a club? Women/men who choose to dance are free to quit their jobs at any time, just as the rest of us are. So much for your "underworld of exploitation theory"
    As far as morality goes and religeon for that matter I
    use it to live my life, not to tell others how they should live theirs.

  • Would Elaine Cook get up there and dance naked also? If she sees nothing wrong with exploiting women for profit, than why doesn't she do it also? Mr Scalzo should be ashamed of himself to do a job of dishonoring women. He calls this a career?Please,do not insult the intelligence of women every where who live an honorable life of raising children to be good citizens and taking care of her home and family and would never do such an ugly thing as disrobing herself in public for money. Mr Scalzo does not set a good example for young people by letting them in his den of sin. He is trying to make his money off of backs of naked women. What kind of man is he?   • Fail? They stand to get over a mil in a suit. It may be failure for the club but I call it bad news for us that live in W-B township. Personally I would rather have left it alone at this point. Between this web site and the other it is making it worse. Mr. Family and the other guy have made it worse. I saw two people arguing today in Price Chopper over who was right. These two sites have escalated this more than it needed to be, all over a booby bar.
    I would love to see the bar go, but not at this price, not when it comes from my families pocket.

You don't live in the area, therefore you don't pay taxes here ..all these law suites will cost the local tax payers many $$$ to defend..even if club 10 looses the case.   • Dancers (and I use that word loosely) how about contributing some of your easy, sleezy cash towards the W-BTwp police department's payroll, the very ones who have to protect you from your "admirers." Your generous contribution will help to relax a possible increase in W-BTwp. residents' taxes...where that money could have gone towards their health care, better health care, medications, or any number of important necessities.

    On second thought,the W-BTwp. police department is too honorable to accept easy, sleezy money.

    Meanwhile as the police must be more vigilant about your safety at that club, crime will have the opportunity to increase elsewhere within their jurisdiction.
    But for you, Sal, and investors, it's 'hurray for me; the heck with everybody else.'

  • If the township just let this LEGAL business operate as any other LEGAL business, they wouldn't be in this predicament. There is no way they will win the latest round either. The ordinances won't be able to be enforced, and the referendum on the no BYOB deal won't be able to be enforced either.

    It's time they just lick their wounds and bite their tongues and move on. The club is open, will stay open, and will stand up to anything the township can throw at it. It hasn't been a nuisance, it's been a good, quiet neighbor. It hasn't lowered any property values, it hasn't been a burden on the fine law enforcement people.

    The Club is here to stay. It has a legal right to operate, like it or not. If the township officials want to keep throwing more money down the drain, and burden the tax payers of the township, I doubt many, or any of the elected officials will see future terms there, and rightly so.

    The township politicians have demonstrated numerous times how inept they are, and they just keep tripping over each other to see who can be most inept of the bunch.

  • Lana, with your comparison of Burger King and folks not going there if they don't like it as comparing that to a strip club, well, there is more to it than that.

    You're right, if people don't like strips clubs they don't have to go. But it's the effects from the strip clubs that still affect people who don't go.

    If you have been following this board, you would have noted that surrounding house values will depreciate and a host of other things that people are directly affected by even though they don't go to strip clubs.

    I'll compare it to street drugs. People don't have to take drugs, and the ones that don't, are still directly affected by them. Robberies and murders occur, again, property values decrease in neighborhoods, and on the whole, crime increases.

    You take it that people are judging others. That is not true. People are saying that they do not want to be affected by strip clubs with the negative effects and influences they have on their communities.
    Since people are obviously involved with deciding to participate in strip clubs, it is going to seem like they are being judged. It is not the people; it is affects and effects that are connected with strip clubs.

    And you're right, God is the only One who can judge. Therefore, that is something ALL of us needs to be most concerned about right now...you, me, everybody. Our number can be up at anytime. We don't have the future, we only have right now. And all the money in the world is not going to make a difference.

  • The property values have NOT depreciated nor will they. The Gentlemen's Club is located in the business district. The arena has brought so many new businesses to Wilkes-Barre township. Having a house in that area can only help its value.

  • anon 2:31 no the council conceived this concept long before the g club permit was filed otherwise there would have been a zoning code against it not for it on the township records.
